These terms apply to the NowCap Android app ("the app"), published by NowStacks (nowstacks.com; "we", "us") and developed by Gemini Digital Solutions. By installing or using the app you agree to them.
1. Using the app
The app is free to use, with no ads and no in-app purchases. We grant you a personal, non-transferable licence to use it on devices you own or control. Do not copy, resell, reverse-engineer or redistribute the app except where the law allows it.
2. Record responsibly
You decide what you record and what you do with it, and you are responsible for it. In particular:
- Get permission before recording other people, their conversations, calls, meetings or classes; recording laws differ from place to place and in many places require everyone's consent.
- Respect copyright and licences: recording streamed films, music, games or other protected content may be prohibited by the service's terms or by law, and Android blacks out protected content on purpose.
- Do not record other people's private information (messages, passwords, payment details) without their permission, and do not use recordings to deceive, harass or harm anyone.
3. Your recordings
Your recordings are yours. The app does not claim any rights in them and never uploads them.
4. Keep copies of important recordings
We are not responsible for recordings that are lost, damaged, interrupted or deleted, including when the phone runs out of storage or battery, Android ends the screen capture, the app is uninstalled or its storage is cleared. Check important recordings straight away and keep a copy elsewhere. What can be recorded depends on your phone: not every resolution, frame rate or codec is available on every device, some apps block audio capture or show black, and phone calls are never recorded.
5. Other apps and services
Sharing hands your files to the apps you choose, which handle them under their own terms. The app is distributed through Google Play under Google Play's terms.
6. Updates
The app checks nowstacks.com for new versions. Occasionally an update may be required to keep using the app, for example to fix a serious problem; the app will tell you when that happens.
7. Availability and changes
We may update, change or discontinue features at any time. We do not guarantee the app will be error-free.
8. Disclaimer and liability
The app is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or any loss of data, arising from your use of the app. Nothing in these terms limits rights you have under consumer law that cannot be excluded.
9. Governing law
These terms are governed by the laws of India, and the courts of Agra, Uttar Pradesh have jurisdiction, unless your local consumer law gives you the right to bring a claim where you live.
10. Changes to these terms
We may update these terms. The new version will be published on this page with a new "Last updated" date; continuing to use the app means you accept it.
